CloakID Terms of Service

This Terms of Service (“ToS”) is the master agreement governing your use of the CloakID Service. By creating an account or using our Service, you agree to these terms.

1. Description of Service

CloakID provides a browser-fingerprinting protection service (the “Service”) consisting of a browser extension paired with a processing gateway hosted in the European Union. On supported websites, the Service presents the website with a common, consistent browser persona in place of your device’s unique fingerprint; the gateway processes page content to support this. Protection applies on supported websites only, and the extension displays the protection state of each page you visit. The Service does not mask your IP address and is not a VPN, and it does not guarantee protection on any website.

We offer a free tier (“CloakID Core”) and may offer a paid subscription tier (“CloakID Pro”). During the current private pilot programme, the Service is provided free of charge to invited participants; pilot-specific terms, where applicable, are set out in a separate Pilot Agreement that supplements these Terms.

2. Subscription and Payment Terms

The following applies where a paid plan is offered and selected. No fees apply during the private pilot programme.

  • Plans: We offer a free “CloakID Core” plan and a paid “CloakID Pro” plan at the price of €10.00 per month or €100.00 per year.

  • Billing: By providing a payment method, you authorize us or our third-party payment processor, Frisbii (formerly Billwerk+), to charge you on a recurring basis.

  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings.

  • PSD2 & SCA: All payments are processed in compliance with the EU’s Payment Services Directive 2 (PSD2), including the use of Strong Customer Authentication (SCA) for your protection.

3. Acceptable Use

You agree to use the Service only in compliance with applicable law and these Terms. In particular, you agree not to: (a) use the Service to commit, facilitate, or conceal unlawful activity, including fraud, harassment, or unauthorized access to systems or data; (b) attempt to circumvent usage limits, access controls, or the intended operation of the Service; (c) interfere with or disrupt the Service or the infrastructure supporting it; or (d) reverse-engineer, decompile, or extract the Service’s components except where such restriction is prohibited by law. We may suspend or terminate access for violations of this section.

4. Warranty Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Because the Service alters how websites perceive your browser and depends on third-party websites and browser platforms that we do not control, we explicitly disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be error-free, uninterrupted, or work with all websites.

5. Limitation of Liability

This clause sets a predictable and insurable cap on our financial liability.

  • Exclusion of Consequential Damages: To the fullest extent permitted by law, in no event will CloakID be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or in connection with these terms or the use of the Service.

  • Cap on Direct Damages: Our total cumulative liability for any direct damages arising from or related to the service will not exceed the total amount of fees you have paid to CloakID in the twelve (12) months immediately preceding the event giving rise to the claim.

6. Indemnification

You agree to defend, indemnify, and hold harmless CloakID, its officers, directors, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service for illegal activities or your violation of these Terms, including Section 3. This clause ensures that you are responsible for the consequences of your own actions while using the Service.

7. Termination

You may terminate this agreement at any time by deleting your account (including via the Service’s account-deletion function), canceling any active subscription, and discontinuing use of the Service. We reserve the right to terminate your access to the Service for a breach of these Terms.

8. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Bulgaria and the European Union.
